Abstract

This comprehensive study examines the efficacy of the Biodiversity Act 2002 within the context of Indian environmental law, with a specific focus on the state of Manipur. The research outlines the legal framework of the Act, discussing its significant role in biodiversity conservation and its pivotal importance in various regions, including Indian biodiversity hotspots. The study further explores the threats to biodiversity and the effectiveness of the Act in addressing these concerns. Additionally, it highlights the specific implications and the operational challenges of implementing this Act in Manipur, addressing both the support and the shortcomings within the legislative and judicial frameworks. Through detailed analysis, the research identifies key loopholes that may hinder the Act’s effectiveness, and proposes recommendations for more robust conservation strategies, incorporating the roles of NGOs and judicial interpretations. This study not only deepens the understanding of biodiversity legislation but also offers a critical assessment of its application and the necessary legal refinements needed to protect India’s rich biological heritage.
